This is not, never was and never would be legally enforceable, and quite why Smith put up with it I've no idea. Cricket boards can't just make up their own provisos to add to laws under which they function.

It was a conditionality for the acceptance of any Kolpak that they agree not to play for their country of origin and applied to all including Smith. Incredibly it even applied to dual citizens like Ryan Harris when he signed as a Uk passport holder for Sussex, but was told he would now be "overseas " in Australia.

ok ,so we agree. But why they put up with it was a commercial decision. Smith traded the uncertainty of West Indies cricket for (what he thought was) the security of a three year contract and a career with Sussex. I expect saffers like Hall etc thought the same.

What seems even more despicable is after making up these rules ECB changed them "to eradicate Kolpaks" and Smith lost his contract because he could no longer qualify for a work permit under new ECB rules. And he couldnt qualify entirely because he honoured his committment to ECB and declined to play for West Indies. Catch 22...So a man with pover 100 internationals in his career no longer qualified for a permit and had undermined his own chances at home.

Whether unenforceable and unlawful or not, no county was going to fight the ECB on this leaving players with no choice.

It's complicated and as TC says not particularly fair on Dwayne Smith, but it wasn't the ECB who wanted the Kolpak rule in the first place and they did the right thing in trying to close it. Counties are still able to field as many Kolpaks as 'local' players as they want providing they meet the same criteria as overseas players, so any relaxation in the rules for overseas players would mean the likes of Garnett Kruger being able to play county cricket as a 'local' player again. As NB said it all seems a bit wishy-washy with the rules and perhaps they could have fought harder but luckily the ECB had the French rugby federation on their side when going to the EU.

I think most of us would simplify by having no special qualification rules but

1.Allowing two work permits at most (Kolpak or Overseas)
2. Requiring a minimum of seven players qualified for England in every team to obtain any subsidy.( thus allowing some EU qualifieds)
3. Making additional grants for more than seven England qualifieds, and under 25s.(thus incentivising for developing young England qualifieds)

One thing people tend forget is that all 'non qualified' players aren't 'Koplaks'.
Dual nationality is one loophole, as his having a Grandparent who emegrated from an EU country. Marrying a Brit/EU resident can help. Then there's living in the UK for a number of years. Finally a cricketer can become a UK national. Stuart Law was amused to be asked if he could speak English when he took the latter route.

Derbyshire had half a team of non qualified but non overseas players in the 1970s & 80s.

Wayne White is moving to Lancashire, according to Charlie Dagnall. With Sarwan back playing for the West Indies, will Leics have a team next season?

The crucial difference though being that White's cricket has made great progress rather than great regress.

BBC Solent twitter is reporting that Wheater is coming to Hampshire. Bit of a blow for Bates but his batting was poor at the end of the season. I hope Bates can keep the gloves in the one day games at least.
